About Sex Abuse

Sexual assault is defined by Merriam Webster dictionary as, “Illegal sexual contact that usually involves force upon a person without consent or is inflicted upon a person who is incapable of giving consent (as because of age or physical or mental incapacity) or who places the assailant (such as a doctor) in a position of trust or authority.”

Victims of sexual abuse or assault may suffer significant trauma that can affect their physical, mental, and financial well-being. Many survivors may need to seek professional therapy to help them cope with the aftermath of the abuse. Additionally, the medical costs and lost wages associated with the abuse can quickly add up, resulting in financial harm.

Although perpetrators of sexual abuse can be punished in criminal court, victims may not receive compensation unless they file a civil sexual assault lawsuit. It is important for survivors to know their legal rights and options, including seeking compensation for the harm they have endured. Taking legal action can provide survivors with a sense of justice and closure, as well as the financial resources necessary to help them heal and move forward with their lives.

Sexual Abuse Includes, but is not limited to the following acts:

  • Sexual Contact: Touching or physical contact of a sexual nature, even without penetration.

  • Sexual Harassment: Unwelcome sexual advances, comments, or requests for sexual favors that create an intimidating environment.

  • Sexual Assault and Rape: Sexual intercourse or penetration with a minor.

  • Grooming: Actions aimed at gaining a child's trust for sexual manipulation.

  • Coercion and Threats: Forcing a detainee to engage in sexual activities against their will.

  • Exhibitionism and Voyeurism Involving Minors: Forcing a minor to observe sexual acts or exposing oneself to a minor.

  • Exploitation: Taking advantage of a detainee's vulnerability for sexual activities.

  • Indecent Exposure to Minors: Engaging in indecent exposure in front of a minor.

  • Inappropriate Relationships: Romantic or sexual relationships between staff and minor detainees.

Sexual Abuse Inside Maryland Juvenile Detention Centers

According to a report by the U.S. Department of Justice, juvenile detention centers in Maryland have the highest rate of sexual abuse in the country. This alarming statistic indicates a severe failure in protecting youth inmates from such abuse across the state's facilities, potentially paving the way for legal actions by survivors seeking damages for their suffering. We are committed to advocating for victims and their families, providing a path to justice and compensation through the legal system.

Recent Legal Advancements for Survivors of Sexual Abuse in Maryland's Juvenile Detention Centers Maryland has recently introduced new legislation that strengthens the rights of sexual abuse survivors, especially those abused as minors. The Child Victims Act, enacted in April 2023, opens new avenues for justice for survivors of childhood sexual abuse. Key features of this legislation include:

  • Elimination of the Statute of Limitations: The law removes time constraints for filing civil lawsuits related to child sexual abuse, enabling survivors to pursue legal action regardless of when the abuse occurred.

  • Unlimited Lookback Period: The Act allows survivors to bring forth lawsuits for past abuse, no matter how long ago the abuse took place, overriding previous time limits.

  • Effective from October 1, 2023, these changes have led to an increase in legal claims against juvenile detention facilities with histories of child sexual abuse.
